A PCRR (Civil Police of Roraima), through the Normandia Police Station, arrested two men in flagrante on Sunday, the 8th, suspected of illegally practicing medicine, engaging in misleading advertising, and possibly engaging in tied sales. The action was triggered after an anonymous tip about the activities of a supposed ophthalmologist in the city.

According to information provided by Regional Duty Officer Juliano Bruno Araújo Franca, the accused A.S.O., 37 years old, was conducting ophthalmological consultations, prescribing and selling prescription glasses without medical qualifications. Upon arrival, police officers confirmed he was performing consultations with a scheduled list of 30 people.

“The agents requested his medical and ophthalmology diplomas, but he could not prove his qualifications, presenting only a high school diploma and a certificate as an optometry technician. He claimed he was not conducting paid consultations, stating they were free, and denied tied sales. The complaint we received indicates that during the consultations, glasses were prescribed and sold by him,” said the delegate.

During the operation, officers also identified T.R.A., 28 years old, who presented himself as the assistant and organizer of the consultations. Various materials used in the consultations and sales were seized, including 164 pairs of glasses with frames and prescription lenses, stamps, ophthalmological equipment such as a digital auto-refractor and a phoropter, as well as card machines and other tools.

In interrogation, A.S.O. stated he works as an optometry technician in Manaus and was performing the services at the request of residents from the city, who consider the prices charged at private clinics to be high. He also claimed he was not charging for consultations or frames, only for lenses. T.R.A. reported that he organized the technician’s trip to Normandia, justifying that the municipality lacks optical stores and that the population has difficulty accessing ophthalmological services.

Both men were charged in flagrante based on Article 282, sole paragraph of the Brazilian Penal Code, which addresses illegal practice of medicine, dentistry, or pharmacy for profit, and Article 67 of Law 8.078/90 of the Consumer Defense Code, which deals with misleading or abusive advertising.

The procedure was documented in a Police Report (Auto de Prisão em Flagrante) by Delegate Juliano Bruno Araújo Franca, who emphasized the seriousness of the conduct.

“It is essential that the population always seeks care from qualified and registered professionals. The illegal practice of medicine is a crime under law and endangers public health. In this case, beyond practicing without proper qualification, there are indications of misleading advertising and possible tied sales,” the delegate highlighted.

As these are bailable crimes, bail was set for the involved parties, who, after payment, will respond to the proceedings free. The seized materials will remain under police custody for the investigation.
